Roll into the holiday season with this beloved Bay Area holiday event: the Niles Canyon Railway Holiday Train of Lights! These tickets are EXTREMELY DIFFICULT TO BOOK, so for a second year in a row, we have CHARTERED THE ENTIRE TRAIN!

This year, we’ll welcome 10 adults and children for free under our EVERY 10th program.

About the outing, from the railway's website: 

Enjoy a 1.5-hour-long round trip through Niles Canyon filled with refreshments, music, and cheer aboard our antique coaches and open cars that feature holiday lights and decorations inside and out.

Our antique coaches and our open cars are decorated for the season, inside and out, and we enjoy holiday music on our 90-minute trip. We have some open cars with roofs where you can enjoy some of the best views of the canyon as our train makes the 90-minute round trip to Sunol and back.

  • FIRST-CLASS SEATING

    DOME: 40 seats
    PARLOR: 30 seats

    DOME and PARLOR: Only dome passengers can get into the dome car and only parlor passengers can get into the parlor car.

    Dome and parlor get complimentary snacks and drinks and board directly to those cars, and can walk the train like the general passengers do to check out the decorations.

    *FAS/MMH fee: $86 per person ages 3+/$16 ages 0-2 ("lap child")
    *Late fee: Please sign up by SEPT. 30, 10 p.m., or a $10 late fee will be charged. 

    *IMPORTANT: We MUST BOOK all 70 first-class seats by Sept. 30 to hold these seats; if we don't and have to cancel, the FAS/MMH fee will be refunded to you or you will have the option to transfer your credits to another outing. If we do fill all 70 seats, the outing will not be refundable

    YOUTH WAIVER & RELEASE AGREEMENT 

    I ACKNOWLEDGE that the program I am going to participate in involves risk and dangers of death, serious injury, property damage, and property loss. I hereby assume all the risks of participating in the event, regardless of their cause. I promise to participate in a safe and prudent manner, so as not to endanger others or myself. In consideration of being permitted to participate in the event, I, for myself, my personal representatives, my administrators, my heirs, my next of kin, my survivors, my successors, and my assigns: 

    A. HEREBY DISCHARGE, COVENANT NOT TO SUE, and RELEASE Family Adventure Squad/Mommy & Me Hiking (FAS/MMH), and/or its respective administrators, directors, agents, officers, members, volunteers, representatives, and employees, other participants, any sponsors, funders, advertisers, vendors, manufacturers and, if applicable, owners and lessors of premises on which the event takes place, (each considered one of the “RELEASEES” herein) FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON MY ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS; AND I FURTHER AGREE that if, despite this Agreement I, or anyone on my behalf, makes a claim against any of the Releases, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim. Moreover, if any disputes arise under or relate to this Agreement or the event, they will be brought exclusively in a state or federal courts in the State of California, Santa Clara County, and this Agreement shall be governed by and construed and enforced in accordance with the laws of the State of California, without giving effect to the conflicts of laws principles thereof. 

    B. CONSENT to receive medical treatment that may be deemed advisable as a result of any injuries I receive during the event and agree that I am solely responsible for all costs, including diagnosis, treatment, medical transportation, and evacuation, that may become necessary for me or another person as a result of any of my actions during the event. 

    C. AGREE that any photographs and video footage taken of me during the event, as well as any written documents I submit to FAS/MMH, may be printed, reproduced and published in any manner anywhere without any further consent by me or my family members and without any compensation to me. 

    D. AGREE to the following Behavioral Guidelines for this program


    * Participants must take responsibility for their safety by carefully listening to rules and following instructions. Unsafe behavior, failure to follow instructions, or extremely disruptive behavior may result in dismissal from the program.
    * Use and/or possession of firearms, firecrackers, drugs, alcohol, tobacco, and unapproved knives, matches, lighters, or other items deemed dangerous is strictly forbidden.
    * Participants may not damage FAS/MMH’s property or the personal property of others. 

    F. CERTIFY that I have read this document, understand its contents in their entirety, understand that I have given up substantial rights by signing it, and have executed this document below freely and without reservation or duress and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this Agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect. 

    I understand that by choosing to leave my child under the supervision of another adult (with their express agreement), I take full responsibility for my youth participant and as enumerated above in Sections A through F, and assume all risks for my youth participant. 

    Without limiting the foregoing, I, THE MINOR’S PARENT AND/OR LEGAL GUARDIAN, HEREBY DISCHARGE, COVENANT NOT TO SUE, RELEASE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEE’S, FROM ALL LIABILITY, CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE 

    “RELEASEES” OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATIONS AND FURTHER AGREE THAT IF, DESPITE THIS AGREEMENT, I, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF MAKES A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.

    Release of Liability, Assumption of Risk and Indemnification Agreement

    All participants must acknowledge the following Release of Liability, Assumption of Risk and Indemnification Agreement. 

    1. Trip and associated risks - I have chosen to participate in the above referenced trip (hereinafter referred to as "the Trip"), which is organized by Family Adventure Squad/Mommy & Me Hiking. I understand that:

      • The Trip involves activities that are inherently hazardous, including those described in the separate document for the Trip, "Activity Level and Risks & Hazards," which has been provided to me and which I am also signing and returning;

      • During the Trip, I may be exposed to dangers and hazards, including equipment failures and negligence by others;

      • As a consequence of these risks, I may be seriously hurt or disabled or may die from the resulting injuries, and that my property may also be damaged;

      • Hospital facilities, qualified medical care, and emergency medical evacuation may be limited or unavailable during portions of the Trip and, where available, may be expensive; and

      • Mommy & Me Hiking assumes no responsibility for providing medical care during the Trip, and I will have to pay for any medical care and/or evacuation that I incur. In consideration of the permission to participate in the Trip, I agree to the terms contained in this document.

    2. Assumption of the risks - I hereby freely assume the above mentioned risks and any harm, injury or loss that may occur to me or my property as a result of my participation in the Trip-including any risks caused by the negligence of Mommy & Me Hiking, its employees and officers, its contractors, and other trip participants.

    3. Waiver and release of liability - I hereby WAIVE AND RELEASE ALL LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS against Family Adventure Squad/Mommy & Me Hiking, its employees, officers, directors, vendors and contractors ("Released Parties"), where such LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS arise in any way from any injury, death, loss or harm (whether foreseen or unforeseen) that occur to me or to any other person or to any property during the Trip or are in any way related to the Trip. This release includes, but is not limited to, claims for the negligence of the Released Parties and claims for strict liability for abnormally dangerous activities. This release does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be released by agreement. I also agree NOT TO SUE or make a claim against the Released Parties for death, injuries, loss, or harm that occur on the Trip.

    4. Indemnification hold harmless and defense - I promise to INDEMNIFY, WARRANT, HOLD HARMLESS AND DEFEND the Released Parties (defined in Section 3) against any and all LIABILITIES, CAUSES OF ACTION, CLAIMS AND DEMANDS that arise from my acts or my failure to act (including my own negligence) during or relating to the Trip. In accordance with this promise, I will reimburse the Released Parties for any damages, reasonable settlements and defense costs, including attorney's fees, that they incur because of any such claims made against them. I agree that in the event of my death or disability, the terms of this agreement, including the indemnification obligation in this Section, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them.

    5. Severability - I agree that the purpose of this agreement is that it shall be an enforceable release of liability and indemnity as broad and inclusive as is permitted by California law. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.

    6. Applicable law, forum & attorney's fees - This agreement is governed by and shall be construed in accordance with the laws of the state of California, without any reference to its choice of law rules. I agree that any dispute arising from this Agreement or in any way associated with the Trip shall be brought in Santa Clara Superior Court of Santa Clara County, California, or in the United States District Court for the Northern District of California, and I agree to the jurisdiction and venue of those courts for any such dispute. In any litigation in which the validity or enforceability of this agreement is contested, I agree that the prevailing party will pay all attorney's fees and costs of the parties seeking to uphold the agreement.

    I have fully informed myself of the contents of this agreement by reading it before signing it. No oral representations, statements or other inducements to sign this release have been made apart from what is contained in this document.

    If participant is a minor, signature of parent or guardian is also required: In consideration of my minor child's being permitted to participate in the Trip, I accept and agree to the full contents of this agreement. I understand that I am responsible for and I accept the responsibility for the supervision throughout the duration of the Trip of any minor traveling in my care. I also agree to RELEASE, HOLD HARMLESS, INDEMNIFY AND DEFEND the Released Parties (defined in Section 3) from all liabilities and claims that arise in any way from any injury, death, loss or harm that occurs to my minor child during the Trip or in any way related to the Trip. This includes any claim of the minor and any claim arising from the negligence of the Released Parties. I understand that nothing in this agreement is intended to release claims for gross negligence, intentional or reckless misconduct, or any other liabilities that California law does not permit to be excluded by agreement.

    CODE OF CONDUCT

    • Bring your best self to the outing. Positive energy, looking forward to adventure and making new friendships. Non-compassionate behaviors like bullying, verbal attacks (like yelling), identity-based discrimination of others (including race, gender, sexuality, religion, ability and nationality), participating in “cliques” or gossip, will not be tolerated.

    1. Mommy & Me Hiking is about many things, but in particular, building community in the outdoors. Families are expected to participate in most activities and not choose “a la carte” or disappear from the group mid outing. We’ve provided a sign-in/out sheet if you are going to do something else and we do understand if people need down time or aren’t feeling well (and if you’re not feeling well, please let us know). You must complete the sign-in/out spreadsheet if you are leaving camp without the group. Also, exclusive relationships don’t make for a great group experience. Groups are better when everyone contributes and is part of the team.

    2. Clean up after yourself. Let’s do our best to leave no trace.

    3. Adhere to staff instruction or instruction from the park rangers. Not following instructions, especially regarding safety (like on a hike) or putting out a fire, puts the group at risk. 

    4. For camping adventures, recommended quiet time is 9 p.m. We’ll remind families of this but those who are going to sleep before then and those who are staying up need to be mindful of others and that camp will not be a perfectly quiet place, especially with families with young children. Let’s all be compassionate and respectful. Hopefully, we’ll all get a good night's sleep in the outdoors.

    In signing this, you understand there may be a “zero-tolerance” policy for not adhering to the Code of Conduct. You also understand that if you, your partner, or your child(ren) repeatedly refuses to fully participate, follow instructions, or abide by the Code of Conduct, this may result in early dismissal from the outing. In the event of an early dismissal no refund or credits will be given.
